So if Harvey announced he was running for public office you’d give him a break? That’s not a swing and a miss, it proves that you are morally bankrupt.

What’s the strawman? Im just saying to hold your own party to the same standard you do the Democrats. If you don’t, you’re a fricking hypocrite and by definition have no moral integrity. You saying my argument is a strawman’s is as ridiculous as Leftists saying everything they don’t like is racist or sexist. You have no moral integrity.

Is not the Justice Department part of the executive branch? Is it not the job of the executive branch to ensure that laws are followed and to punish those who don't. Congress makes law and the executive branch enforces law. Decisions have to be made as to the direction of the law enforcement body, because you just have to prioritize. The president absolutely has the authority to direct the direction of the justice department. It is literally his job, in my opinion.

So, you're OK if a POTUS hands over a CD full of classified material to a foreign power and then directs the DOJ not to look into the matter? What if the POTUS shoots someone out on the street? Can he nix that investigation? Where is the line? Waht is the limit to this power?

Well, that is a nonsensical statement lacking in substance. I think I see your point however. But, for giggles, what were your thought when Obama announced DACA?

For those in the "well Dershowitz is a Harvard..." camp, would it affect your assessment if he was taking flights with Bill Clinton on the Lolita Express?

I think Dershowitz is wrong. Part of justice is determining the truth with regard to whether or not criminal acts took place and the people involved. So, the power to pardon is not relevant there.
Also, I think it's a stretch to give prosecutorial discretion to the POTUS. That is dangerously close to whimsical execution of the law which is what the Revolution was start to combat.

Dershowitz is correct, and Congress still has a remedy. They would still have the ability to impeach and remove the President.

Dershowitz is wrong. If he was right, you would not find any logic behind things like Unlawful Command Influence in the military. Look at the scandal with the USMC a few years ago and Gen Amos. Some heavy hitters wanted to take a UCI case against him and even up to POTUS. That got squashed with some underhanded BS at lower levels because they did not want that type of case or argument moving forward. If Dershowitz was right, and if his brand of logic could be extended like this, they would have welcomed that argument and promptly shut it down.

To your second point, Congress is not a sufficient remedy. When have you ever seen a Congressional investigation that rivals what the FBI and DOJ can / will do? The answer to that is probably never. Ask yourself whether or not the DOJ would have wrecked shop in the IRS scandal where they targeted conservative groups - the answer is Hell Yes! What was the final result of a Congressional investigation? An apology. Koskinen wasn't even fired. Look at what George Webb has pieced together about Benghazi. Compare that to what Congress came up with. Now extend that to what the DOJ has the ability and authority to do.

The investigative powers or Congress are no substitute for the DOJ. That is why it's so important that the DOJ remain forthright and neutral. That is why Trump needs to keep pushing this stuff hard, and get us to where the DOJ is doing its job, absent of political bias.

Dershowitz is incorrect.

I’m not going to bother explaining why. I’ll just let you guys melt and downvote this reply.

But I’ll bump it when I’m right.

FBI investigations aren't proceedings as required by the Code for Obstruction

We will be waiting a while for your bump. The DOJ prosecutors Manual is pretty clear.

Last paragraph:
quote:

However, investigations by the Federal Bureau of Investigation (FBI) are not section 1505 proceedings.

So you can smugly sit there and claim to know something everyone else doesn't. In reality, you are ignorant of how it works. Typical dem.
Try again.

Meh.

I'm not a doctor either. Hence, if deciding which information is more trustworthy, I'm probably going to choose the John's Hopkins doctor over some random message board guy who doesn't even claim medical expertise

nah - although it would be poetic justice to balance out a Ginsberg/Kagen/Sotemeyor rubber stamp for the latest SJW bullshite to make it to the SCOTUS.

I think enough progress is being made with REAL justices that we don't need to go the route the DEMs have done for 50 years with putting wild-eyed SJW dipshits on the court
