Exceptions To The 10 Year Restriction

If you are convicted of a DUI, it still may be possible to gain entry to Canada during the ten year restriction. However, it will take planning, effort and help.

In order to enter Canada with a DUI conviction on your records, you will either need to be deemed “rehabilitated” or granted a temporary resident permit.

A person is deemed rehabilitated if he has no criminal convictions for a minimum of 5 years after the completion of the imposed sentence.

Buddy got shut down at the border when in Seattle for the UW LSU game. DWI several years before the trip.

I when on a goose hunt up in Canada, one of the older guys we were with had gotten a DUI in the 80s. It popped up and the Canadian airport police (Mounties?) took him to the back and when through his luggage and asked him some basic questions and let us go.

Canada won't let people in for DWI but the US releases Mexican criminals back on the streets of the US and everyone says Canada is some sort of utopia for immigrants.

Been there. Entered Canada via Thousands Island bridge in 2004. Was asked to pull over. They asked my wife and I to go inside the border patrol/customs building. I was questioned about my alcohol fueled transgressions in the college years inclusive of 1991-1994. They didn't stop me from entering but I was held up to pay some sort of DUI waiver fee of around $250. So, it's not about safety, it's about money.

Fast forward to 2014 and we go to Niagara Fall with the family (wife + 2 boys now ages 4 & 6 at the time). We drive across and the border guard closes his window for a second and my heart drops. He opens it and says "Pull over, eh" (I added the "eh" part). Border guard comes out, pulls me out of the vehicle in front of the kids and then asks if I had trouble getting through customs in 2004. I said yes, told him the story, he walked in the building, came back out, gave me my passport and said "Enjoy Canada with your family." He then walked over to the car and told the boys something like "We were just confirming your reservation at Great Wolf Lodge and told them to make sure they have the water slides ready!" or something like that.

Stayed in Niagra Falls for the LSU game. I personally drove into Canada with someone who had a DWI in 2012.

He was worried as hell that he wouldn't be admitted, but we drove in and out on three separate occasions, they scanned his passport each time, and he never got so much as a question about it.

A guy I know moved to Canada a few years ago, after he got married, and he had to jump through a million hoops. He had to prove that he would be working as soon as he moved there and had to regularly check in with a government worker to show he was employed. He also had to prove that he was working on becoming a Canadian citizen and not just there to b.s. and not be legal. So, yeah this doesn't surprise me. Canada doesn't want riff raff in their country.

I do wonder what effect an Article 894 plea has on this. Doesn't that mean the conviction is never entered? Thus, would an 894 DUI count for exclusion purposes?
