Well, if you read superman, lex does end up in prison several times. So its not unheard of, but I think its a lack of vision. Lex really should have been in every movie IMHO. Maybe just a bit here or there, but if you read the comics he has his fingers in everything.

Hell and i know this and i am just a casual superman reader. I can imagine hardcore readers going apeshit over it.

That should have been much later into the series. Luthor should be the villain with good publicity for a while. He's a pretty good Karma Houdini. Really we should have had about a dozen DCEU movies before Luthor sniffs the inside of a jail cell. And after creating Doomsday and being absolutely crazy, no one is going to want to follow him.
