And don't forget Fuller shitting the bed with the "WEEDY DEFENSE"!
Posted on 12/10/16 at 8:54 am to Athis
Yea if I was the prosecutor I would definitely be calling for Weedy to take the stand. Hard to imagine why Fuller thought his first witness wouldn't be anything other than a complete train wreck.

Seemed like a complete overreaction as the witness didn't even get the call to come testify till 2 in the afternoon

Yeah, I thought Fuller could've been a little harder on her when she was on the stand, but maybe he'll call her back up.
He had to be real careful with her. The lady was shot twice (by his client) and her husband was shot to death while she was screaming in pain. She tried to stop any potential issue, so she is a sympathetic figure and you don't want to turn the jury against you completely by going at her too hard. Of course she needs to be thoroughly questioned and have inconsistencies examined, but that's a difficult situation.
Either way, there hasn't been much of anything in Hayes favor so far and it does appear that he turned into the real aggressor after he hit the back of Smith's vehicle. They still haven't explained why he shot Smith's wife first (and two times). She was no threat.

illegal since he did not have a concealed carry license
Not necessarily and not really provable. If Hayes tucked the gun under his shirt with no ccl, that would be illegal. If he tucked it in the back my of his waistband where no one saw it, but it was outside of his shirt, that would be open carry and totally legal. No one saw, so it can't be proven what he did.

He obviously has very little to work with. His best chance is to keep focusing on the moron with the shirt off trying to escalate things, distract the jury and come up with a Johnny Cochran line because he doesn't have much else that looks good for the defendant at this point.

Having thought about this overnight: I think if:
1) Hayes testifies Fuller is going for an acquittal.
2) If not he is going for manslaughter

How much time does manslaughter carry?

Donald Chick Foret ?@chickforet
Maximum of 40 yrs. which is what I am sure Judge Buras would sentence him to.

quote:I agree, but that PI testimony shows that Fuller has spent little time with that witness prior to the trial. What's the old rule for examining a witness? Never ask a question for which you don't know the answer. Fuller and Daniels had no idea what that witness was going to say.

This is Fuller's idea of coming to court fully prepared? Fuller's professional reputation started to circle the drain with that testimony.

Wonder if this is gonna go to the jury today

What did Fuller ask PI on the witness stand? All I've seen is what ADA asked him. Why did Fuller call him as a witness?

Convicted felons can walk around and open carry? I'm definitely going to have to try to find that law online.

Cardell Hayes is not a convicted felon.
Posted on 12/10/16 at 10:32 am to tLSU
Oh ok thanks I had read early on that he had been convicted of a couple felonies prior to this.
