I paid him based on progress. So he had completed 85% of the work, and I had paid him for that. Work came to a crawl after that and not much was completed. The contract completion date came and went and I haven't paid him any more, so those 3% late penalties grew to 15%. So that's why I said that I have "technically" paid in full.

So he KNOWS that you won't pay him anything else to finish the work? I'm guessing since it was the lowest bidder his name was Jose, or Juan, or Pablo? You'll never see him again, and he has probably already changed his name

One thing to note - If I had kept him on to finish everything, he would have owes me thousands of dollars in late penalties, plus the cost to finish everything. It would not have been practical for him to continue.

gotcha,sounds like you dispersed money the right way, just got a contractor that doesn't know how to manage his money(pretty common with the small guys,) good luck with finishing it up

if you have paid for what you received, i wouldnt hold my breathe on late penalties or more work being completed.
take that 15% you didnt pay yet, and it should get you close to where you need to be with someone else. youll probably come out behind, but hopefully not too drastically.

Is he a licensed, bonded, and insured contractor and was having a bond stipulated in the contract? If so get with a lawyer and call his bond in.

bonding is usually stipulated by the party putting the job out for bid, the bonding that little guys like this are referring to when they say they are bonded is really more more of a type of liability insurance implying that they aren't going to sue the owner for getting hurt on their job site, for example

So you paid for 85% of the work and 85% of the work has been completed? You aren't trying to recoup any lost money. You're trying to profit from the situation.

The problem you will run into in trying to hire another contractor to step in and finish is that none of the new potential contractors will provide any type of warranty for the work since they are tacking on to/finishing someone elses work. Many times, they will simply pass on the job if they hear that they are stepping in on incomplete work. My parents are going through the same issues right now.

True but having a performance bond as part of the contract would've helped the OP out in this situation.
You can always (and should always) require a performance bond. It should be a red flag if the contractor balks at this stipulation.

That 15% is about $5k. It helps, but I'm still over budget by $5-7k if I hire someone else to finish.
