I added on to this as there is no doubt that regulating what goes on in private business can be done if it serves a significant interest of the state.
This smoking ban wasn't a significant state interest and I'm glad it failed.

agreed and I don't smoke. I think the smokers- nasty thought their habit may be- deserve a public place to smoke. Let the business owner decide what is in his best interest to do. If they want to accommodate the smokers, let them.
