Once the papers get word of this, it's gonna taint the jury pool. They may have to move the trial out of state.

I honestly am thinking about getting one of those GPS devices that constantly records video. You could at least "estimate" speed by using the video. Could also come in handy in other situations.

No doubt. That ish is going to be his bloody glove moment. It's just a shame they won't allow cameras in the courtroom, this kind of real life drama would be something to see.

I fought a ticket once and won because I got a little lucky in court.

I got a ticket for 60 in a 35. I went to court and and to the judge I flat denied that I was doing 60. The judge turned to the cop and the cop said, "yeah you were the guy on the Honda motorcycle!". I replied, "no, I was the guy in the Honda Prelude."

The judge looked at my registration, handed it back to me and said, "you're dismissed."

ETA: I believe the judge just wanted to get through the cases. He seemed rushed. So that also worked in my favor.

The best chance you have is to try to get your court date moved back. Also try to get it on a day of the week that is different than the one the officer puts down or the one you are given. The officer will obviously put his normal day of the week for court. If you get it on a different week day then he probably won't show up. Some courts are always on the same day; some aren't. If he doesn't show up, they will throw it out.

Research this for more understanding.

You could also research to see if the officer calibrated his radar gun. They often skip their monthly calibration. If the officer doesn't have calibration certification, you can also get the ticket thrown out. All calibration information is supposed to be available to the public.

I have actually beat several. If I don't think I was doing that speed I fight it. Simple as that.
I have received tickets that I paid and didn't think twice about. If I wasn't speeding it gets fought.

Most people don't fight them and they count on that. File a discovery motion and get all the info you can about the officers training, gun calibration, Speed detection device user manual and so on.

If you have to go to court know the equipment better than the officer. Make him look bad on the stand. Ask questions like " What percentage of speed detections are false". If he says "none" you can quote the manual. If he says "10%" or something like that you can ask how he knew that your reading was correct. You can crush his credibility.

Get Creative!

My last ticket was on I-10 at Bluebonnet. In a construction zone. LA-32:63 was the law I "broke" it states the LA DOTD can set the speed limit if they have completed a traffic study. I called the DOTD and asked for the study. They didn't have one because the engineering company doing the construction work had all the engineering data. I called the DOTD sign shop and asked who put up the speed limit signs. Turns out the construction company did it themselves with nothing official telling them to do it.

Guess what? They don't have the legal authority to do that. On top of that the state police set up a speed trap to catch people violating a lower speed limit that didn't exist.

So legally the speed limit in that zone was 70 although the signs said 50. The DA argued that whatever the sign says is the speed limit no matter who put it there. I said "is the same statement true if I put up one that says 100 MPH"? Charges dismissed, case closed.

What Arcalades said. Continue it as many times as you can. Try to get it to a day when the officer doesn't show up, then seek dismissal. If you try it expect to lose but at the least you can make it a "civics lesson." It is sad but true that in MOST (not all) of these traffic or "police court" situations, even though the burden of proof is on the officer, you are going to be found guilty no matter how flimsy the "proof" is.

It was absolutely 65. I took video/pictures of the signs and area when I drove back through.

And the cruise was set at 67.

Of course I wouldn't use that kind of language in court. I've had to testify in court as part of my job before.

I know to be firm in the court room, the OT is not the court room. Court of public opinion? YES. Court room? No

Are you saying you don't recall the exact speed?

Exact speed was 67.

And not directed specifically at you- but why, if I was speeding and obviously saw the trooper (given I got over as a courtesy)would I not bother to hit the brakes at the alleged 77MPH? And that obviously won't matter in the court room.

Same shite happened to me. I'm fighting it all the way. I'll make him justify the ticket, and at the least I think I have a good chance at getting the ticket reduced.
