If we're rolling with spoilers I wouldn't bet on Spiderman staying on Team Stark.
As an aside Civil War was such a huge boondoggle, it had its moments but man to think that the main creators of the event thought the sides were balanced and that readers wouldn't all essentially side with the side led by the paragon of American goodness (even to the point of breaking with the American government multiple times) over the alcoholic arms dealer who created secret prisons and cloned one of his oldest friends to make a murder bot (shocker that a collaboration with Hank Pym on an AI project didn't go according to plan) is just a stunning misread of your customer base.

Do they avoid the obvious and hackneyed scene where the Black Panther is in his throne room and Stark and Cap come in to plead their case but his only response is to shake his head and go "white people" or "Americans" or whatever?

Well to answer this question for you, in the Civil War comics Iron Man beats the shite out Captain America almost to the brink of death and it isn't even close. So Iron Man, War Machine >(by a frick ton) over Captain American and the Winter Soldier.
ETA: The Winter Soldier is also a casualty of the Civil War in the comics.

In the comics, Witch can hex you out of existence. It remains to be seen if she will be that powerful in the movies.

before Cap turns himself in and then is later assassinated.
leads to the Death of Captain America storyline in which The Winter Soldier takes up the mantle.

You see I thought it was brilliant. Even though I was cheering for cap, it paved the way for dark reign a concept I really enjoyed.
Eta:and also led to back from the dead Thor basically telling Tony that he was going to kill him...which was one of my favorite moments.

I don't remember the whole series but didn't Tony beat Cap's arse earlier in the series which led to them dropping an emp or something to nullify his suit in the final fight so cap could kick his arse basically telling him he ain't shite without his tech.

Well hence the conflict. I believe it was a cheap shot by Tony, or some sort of diversion that statred the first fight...
A character like Pym(who was a pro-reg Skrull in CW), Wasp or Lang fits that bill.

Any side that Reed Richards takes is almost by definition the wrong one. therefore, the pro-reg forces were wrong. That said, I do like that it starts with the New Warriors being stupid. Nothing like making fun of the New Warriors.

If they do this like the comics they need to add the Thor/ Iron Man fight that was hilarious- just hitting a guy in a metal suit with lightning over and over again until his system burns out then going in with the hammer.

This kind of bugged me in CA:TWS. He is a great assassin and in the fights with Widow and CA, his shots we're non vital that landed. He had a clear shot on widow that was more shoulder when he could have killed her at the bridge.
