Justified if it was over his property IMO.
People need to keep these things over their land or use them in public spaces. You do have air rights over your property and I doubt this drone was flying above where air rights end which would also be illegal since that is FAA controlled airspace.
This is going to become a bigger and bigger issue.

It just seems like a ridiculous thing to do, unless you have talked to the owner and given them warning
Let's say someone is taking drone photos of a house for a real estate listing and it passes over your yard, shooting it seems pretty ridiculous, even though you may not know their intentions
Now if you own 50 acres and see one over your secluded property, I may have a different opinion

As drones become more popular someone is going to come out with a handheld emp device to solve this issue so you don't get arrested for discharging a firearm.
