If someone is wearing a current issue but missed the mark by using the wrong insignia they still have attempted to impersonate an officer. If they have an uniform that is no longer in use they are not break the law unless they are attempting financial gain.

Yes, the Stolen Valor Act of 2005 and 2013 don't pertain to active uniforms, U.S. v. Alvarez and the revisions of the 2005 Stolen Valor Act in 2013 send a clear message that there are striking 1st Amendment considerations at play. Not to mention the loads of dicta dating back from the 60's and on concerning this issue.
I don't know the exact facts at play in this fake Green Beret situation, so I won't comment on it.
I do know the ACLU would have a field day with 10 USC 771/2 in a number of other situations (hence the lack of prosecution pursuant to 10 U.S.C. 771 and 772).

First off the constitution grants someone free speech. So to say something to the effect that you are military or a medal or award winner when you aren't is an exercise of 1st amendment rights. The constitution does not give you the right to undermine national security. So you cannot exercise the use of speech to threaten the President or breach classified or top secret data.
By impersonating a military officer it threatens the security of the public. The same would true of impersonating a postman or police officer.

Whether that interest outweighs the constitutional liberties protected by the 1st amendment is a question SCOTUS would have to determine. In my opinion, it would be a toss-up...especially if certain facts were at play.
There's a reason you don't see many of these frauds being prosecuted.
Public humiliation is a much better way to serve justice. As many on here have said, sometimes the veterans confronting the fakes need to have a little more control of their emotions. IMHO.

I love that show, but also feel like he seems fake as frick. How overboard he goes with it is unreal, "you know matt I have a history of smoking out guys in afghan," as he attempts to get rats out of a hut. "You know Matt I tracked bad guys, sometimes for days in Afghan."

You Sir are guilty of impersonating a member of JAG but I got news for you, it isn't a crime. No matter what legal-sounding words you use or the length and number of your posts, it doesn't change the fact that simply wearing the uniform is NOT a crime. I do love that you use the National Security argument though. Hell, maybe we should argue it is for the children too. And stop mentioning dressing up like a police officer. If that was the case, they should lock up Kip Holden and half the sorority girls from LSU every Halloween. It is not how you dress or what you say, it is HOW you do it. I can wear a military uniform all day long. It is when I try to get a free meal or gain access to a secure area on base using that uniform that the action becomes illegal. Note the subtlety there, it's not the uniform but the action (how it is used) that is illegal. Despite what some folks think, the USA is still basically a free country.
If you are so sure of your point, log into WesLaw and find me a single cite of a case where someone has been successfully prosecuted for the simple wearing of a military uniform with no other action gaining benefit. There should be plenty given the number of videos online.

I'm sure all 15 pararescue airmen are badass. It's like Navy commercials where all they show is seals. Sure they exist but let's just be honest and admit you are probably going to be a machinists mate. Nothing wrong with that at all. Grunts can't do anything with out the 85% of the military that supports them.

Its just funny when Navy people shite on the AF bc the only difference is they are on a ship. Both are the two technical branches.
