OP here...wow, go away for 12 hours and get all this! To answer a few questions:
--no, it's not bullshite...it actually happened this way
--no, I'm not holding his parents responsible--he's 18 and technically an adult. However, I have an 18 y/o and know just how worldly they are NOT. Just want to scare the shite out of him.
--I'm not about to let an 18 y/o (see above comment) try to repair a 2 week old 2015 vehicle.
--yes, of course we contacted our insurance and the adjustor actually called said 18 y/o.
Resolution is we're getting it fixed, bypassing the insurance, and the kid is coughing up the bucks (supposedly) after we gave him a reasonable estimate/amount (we got 2 of them).
(of course, it's a two-party, out-of-state, temporary check... )

A few years ago a woman on a 10 speed ran into the back of my truck as I was backing out of my drive way. It was shortly after a hurricane and most of my neighbors had large piles of branches and debris out by the road to be picked up by the trash man so it made it difficult to see down the road as I backed out. She was also wearing headphones and admitted to not looking straight ahead at the time of the accident. I received no ticket and the police stated that it was a dual fault accident. Of course she needed to be picked up by an ambulance because her hand got caught in the wheel well and actually had to have a small piece of her finger amputated. Long story short she sued me and the insurance company settled for $200K. I was also stuck with the bill to fix the huge dent she put on the side of my truck.

Doesn't the driver/cyclist/person on the street have the right of way? How was it dual fault? Were they going the wrong way on a one way or something?

When the cop asked her if she didn't see me backing out she admitted that she was not paying attention to the road. She was basically looking in peoples windows (being nosy) listening to headphones as she was riding along.
