it's not what they had to decide on, but part of the brilliance of the defense is they convinced them it wasn't even something to be considered when in fact it was the #1 piece of evidence.
the female juror said it bluntly, they didn't consider it at all

Well there ya go.
I just think it's funny people saying "the galveston jury was paid off! They're idiots!!!!!" when that really isn't the case.

I'm not speaking about as a crime, I'm talking about as evidence of his guilt...chopping up a body, putting it in hefty bags and dumping it in the ocean is a pretty glaring sign of intent...or worse a pretty glaring sign of experience

galveston jury was paid off
In the Galveston jury's case they were bought or stupid...my wife and I came away with the impression it was the latter. Durst's testimony used "wal mart" like 50 times in just what we saw...his job was to be relatable to the jury and because they're stupid, he succeeded.

They are idiots or they accepted bribes. No rational person should believe that someone who had nothing to do with killing their friend would show up find her body and then chop it up and hide it. That is unreasonable doubt. Since when did common sense take a vacation?
Posted on 3/18/15 at 8:42 am to Tiger Ryno
if I'm ever indicted for murder, I'm telling my lawyer to go jury shopping at wal mart.

Who said that? The jury knew that MB died as a result of RD. That was never the issue, it was did he MURDER him. And the defense had a persuasive enough case to put reasonable doubt in the jury's mind. No one said RD didn't kill him.

quote:I don't understand the confusion either. Durst admitted killing him, claimed self defense, and said he dismembered the body and disposed of it because he didn't think anyone would believe him given the issues with his missing wife. It has a logic to it and his lawyers did a great job of selling that to the jury. It's not rocket surgery.

his lawyers did an incredible job...no doubt BUT
dismembering a body is evidence of pre-meditation. Most people dismember a body so that no one finds out they MURDERED someone. Most people who kill in self defense call the cops.

While I agree, they said that he panicked due to him being on the run from NY for his wife's disappearance (murder). So "normally" doesn't fit.

The defense fricking up in Galveston had more to do with him getting off than the million dollar lawyers IMO
If they were in a less bum frick city with a competent DA, he would've been convicted
I mean look at the Jurors they got for that trial....fricking retards. Makes me think that the Durst Family went full Runaway Jury for that trial

I will say that between L.A., N.Y. and Galveston, the most competent investigator seemed to be the one in the bum frick city

I know how they portrayed his dismembering a body
A smart person would not dismiss that explanation as complete bullshite, and a retard would find him "not guilty"

"He uhh chopped the bodies up...uhh yeah that's uhh
Murder. Yeah premeditated murder..uhhh..."
Sounded like the prosecutor stayed up late watching the Blue collar comedy tour reruns the night before

Durst suspect in the dissapearance of two teenage girls...
Nice Find
from that link...
quote:
Millionaire real estate scion Robert Durst, who sent to a Louisiana facility for mentally incompetent inmates after being charged with a 2000 murder in Los Angeles, is now reportedly being eyed in the disappearances of two California teenagers in the 1990s.
Durst, who was acquitted of murdering his Galveston roommate in 2004, and is the subject of the HBO documentary "The Jinx," is being held in New Orleans on a gun charge and awaiting extradition to Los Angeles even as detectives in Houston search homes the 71-year-old owns there and authorities in Northern California are reportedly revisiting him in connection with the disappearances of Karen Mitchell and Kristen Modafferi. Mitchell, who vanished on Nov. 25, 1997, had volunteered at a homeless shelter in Eureka, Calif., where Durst had been spotted, while Modafferi was a North Carolina college student visiting San Francisco when she disappeared on June 23, 1997.
Wonder if he was practicing again.

I'm surpised that wasn't mentioned in the doc
Seems like they would've ran across that

quote:Dimembering the body is clearly disturbing and indicative of a sick individual; however, the idea that dismemberment is clear evidence of PRE-meditation when it is a behavior that occurs POST-KILLING, is a bit of a logical leap.

I think it could work well as supportive evidence to behaviors before the act; however, as the major evidence for pre-meditation, it's not very strong.
