My MIL gave me a laptop that's bigger, better and newer than my current one. Only thing is the hard drive crapped out on hers. Can I just take the hard drive out of my Gateway, put it in the Asus she gave me and roll?

You'll have an issue with the drivers. Since both of the laptops aren't the same. You'll have to download all the drivers for the new laptop. To save time, it'll be easier to buy a new HDD for the new laptop and install it fresh. Check out this website to compare prices on HDD.

You'll likely get the BSOD with the different hardware. Even moving a hard drive directly to a new PC with same hardware isn't 100% successful.

You can generally get around hardware driver conflicts by uninstalling old drivers and replacing with the correct ones without too many issues, especially in Windows 7 and above (though it's still best practice to do a clean install). But, the biggest issue you're going to face, with no way around it, is the OEM license. Your Gateway came with an OEM version of Windows tied to that vendor and most likely the bios on the Gateway's motherboard, and it's not gonna activate on the Asus.
