I don't think he will get the death penalty, hell I'm not sure he'll be Court Martialed. If the facts show he deserted his post and collaborated with the enemy, then hang his arse. Some of his own died looking for him.

The article says that no charges have been preferred.
The article says nothing about him being "prosecuted" for anything.
At this point in time, these questions remain unanswered.
Did I miss something, or is the statement that he "will be prosecuted for Desertion" premature at this time?

Not sure what article you are looking at but the phrase "desertion charges" kinda lets you know that. Unless at some point those charges are dropped is it a stretch to say he will be prosecuted?

I don't see anywhere in the article where it says that any charges have been preferred.
IF charges were preferred, they would be talking about the charges on the news -- I mean the specific charges citing specific criminal statutes.
The headline of the article is misleading. A careful review of the body of the article leads one to conclude that no charges are preferred at this time.

The Army will buckle on this if Obama is against it. The decision-makers in the Army care about one thing - getting their next star. And that means currying favor on Capitol Hill and 1600 Pennsylvania. I'll be surprised if this ever comes to anything.

I don't think he deserves the death penalty because he didn't collaborate with the enemy directly causing deaths of American soldiers. While his actions ended up causing the loss of life, I don't think that was his intent. I compare it to negligent homicide and first degree murder.

Weren't there reports that he'd mailed home personal items shortly before his disappearance? Didn't he ask his squad leader or platoon sergeant what would happen if he went outside the wire without his weapon and Kevlar? It all sounded pre-planned, if not necessarily well thought out, to me. That's desertion in my book.
On the other hand, based on media reports (and that's all most of us have to rely on, so save the "liberal MSM" bullshite), he was basically a model citizen growing up. Nobody had a bad word to say about him.
This guy might be a nutcase or maybe on drugs, but it sounds like he willingly abandoned his post and put his teammates at risk. He deserves to be held accountable for his actions, but should receive consideration for any mitigating circumstances in his defense.

Article 85 is a criminal statute, right?
If he were charged under Article 85, the news would state that.
If you can find something somewhere indicating that anybody's been charged under Article 85, please post. Things may be moving fast on this matter. More concrete info could break at any time, seems to me.

This is 100% what happened. Unit thought he was captured outside the compound while either on guard duty or something so put together several operations to locate and rescue him resulting in several deaths and several wounded. There were several indicators there was premeditation on leaving. Left all his equipment and had been having exploratory conversations with fellow soldiers on some "What If" scenarios of taking equipment and leaving.

The article states that "army sources" have said he will be tried for desertion. At this point that's all you're going to get until he's actually charged.

I can't believe we actually traded prisoners for this dirt bag. I thought we never negotiated with terrorists. That's what we keep saying everytime someone gets imprisoned in North Korea or snatched up by Isis.
