ome states do not have a "close-in-age" exception and it would be stautory rape.

Which states would it be statutory rape for a 17 year old and a 16 year old?
Eta: just read some of the different laws and this is true. In some states any two minors having sex is against the law. I'm guessing that law gets enforced basically never but interesting nonetheless.

If he got into a fight with the girls dad in the dads house yes he could have been legally shot.

Why does it matter where the fight was? The kid was invited into the house, so he isn't trespassing. You can't invite someone into your house, start a fight with him, then shoot him and claim self defense because he was in your house.

The only way the dad has a chance here is if the girl told him that the boyfriend was an intruder.

Which, according to reports, is exactly what she told him.

She fessed up AFTER he was killed.

In Missouri this would be 2nd degree child molestation.

In NY State this would be sexual misconduct, a misdemeanor.

Calling it stautory rape is probably incorrect, but it could be a crime in some states. If he had been 18 this would be a felony in quite a few. Also, if he happened to be in the military it would be a violation of the UCMJ.

Dumb question. Can a minor invite someone on to a property without the consent of the owner of said poperty? I mean, my son can't give permission for someone else to hunt on my land.

If true then he walks. The mentality of a father protecting his daughter from a male intruder, in Texas... Walk

IDK, I don't think they let you shoot people bc your daughter is a whore, even in TX.

If the dad is under the impression, mistaken or not, that the guy is an intruder up to no good and has made a move to grab at something he can't see, it would probably be considered a good shoot.

Not his fault his daughter is a dumbass who lied about being a ho.

It may not result in the charges being completely dismissed but it sure as hell makes a difference when it comes to criminal intent. This could be the difference in a manslaughter or 2nd degree murder.

Maybe the 17 year old was bigger...and in shape? Think most of our images are of a 170 LB kid but dude might have been Robert Nkemdiche big or a 6' 2" 225 LB guy who can throw down.

I really doubt the kid started a fight though. As I mentioned before, the kid might have been trying to charge through the bedroom door to flee and the father, blocking the door, thought he was being charged.

This is a very interesting case.

If I believe I have a home invasion in my daughter's bedroom and it appears like someone is raping my daughter Im grabbing a gun if I have one and I dont give a rats arse about prison when I fire.

A 17 year old is not a child..
