Just peeked at it on website, so basically the way the law is written, the only way one could have a homebrew event is to have it at a licensed retail location. Say Martin's.
A special event is a licensed location by state ATC, but whether or not it is a licensed retail event is the rub. So in short its regulatory interpretation.
Its my opinion, the new ATC commissioner, Troy Hebert, is much more adept and available to work through thorny issues than Painter ever was. He recognizes alcohol, and specifically "boutique" alcohol is a thriving market and one Louisiana should capitalize on.

$30 is on the low low side for me.
I can't remember the last time I spent less that $40 on ingredients and that was recycling yeast.
Plus all of the little odds and ends that go into the brew day and the time.
That being said, I look forward to and enjoy pouring our beers to people with only a wristband as re-payment.
Will brew our grapefruit RyePA this weekend for it.

Yeah, $30 is a cheap batch... I really hope it gets worked out and can run like normal. I really don't want to pay two entry fees on top of the beer cost.

Come over to the dark side of farmhouse ales where batches cost me $20. Plus Brewstock is pretty cheap and I buy expired yeast or re-use it.

We have a number of guys who brew two beers for these events... It will be a hard sell to ask them for another $35 on top of that.
As for the ATC, I'll just say that we never had any issues when dealing with the old commissioner and his interpretations of the statutes.
Its only been in the past few months that serving homebrew at festivals has become an issue.

We'll be bringing our Grapefruit Rye and a Bohemian pilsner.
A few bottles of the Grapefruit Rye will be heading to Karbach for their Pro-Am.

There also wasn't a homebrew special event law on the books when Painter was there.

See that isn't how I see the issue. As a homebrewer, the ATC has no legal authority over me. So if I want to bring my beer into a field and invite all my friends to come drink it, the ATC can do nothing to stop me. Understandably, the ATC does not want untaxed booze in a space that sells alcohol bc the state would be losing revenue and authority. But if a place is not in the business of selling alcohol and we are not selling the homebrew, then the ATC should still have no authority over me.
I am of the opinion that if a law/permit/statue doesn't say I cannot do something, then I can do it. The ATC (through my experience) claims that since the law doesn't say I can do it that means that I cannot do it.

I agree with you. But what the ATC will say is as soon as admission is charged or money is exchanged for the distribution of that homebrewed beer, it becomes the state's obligation to regulate it.
So yes, you can go into a field, invite the whole world to drink your homebrew, but if you charge admission or by the glass, its a different story.
All alcohol regulations, in each state of the nation, have weird peculiarities.

Ehh, go live in a state where you can only purchase alcohol at specific times and/or at specific state run stores. That is a real bummer. The three tier system stinks, but it really is only a pain in the arse on the consumer side for beer.

Yea, this makes sense. I was more speaking of the permit specifically when it says that the Commissioner can issue a permit to a retail establishment, and that means that you cannot have an event any place else. To me that just says I don't have to get the permit for anyplace else.
Obviously the admission fee is an interesting aspect of the issue. An aspect that this current administration cares a lot about, unlike in the past.

All of this is being driven by rogue operators who would come in for things like the Super Bowl or All star game, rent out a place, and throw a "private event" and shite would go down and the promoters of these parties would be gone before the money cleared the bank.
It sucks that homebrewers, and all festivals really, are being lumped in to atone for the sins of booze carneys.

Id think it being a pain in the arse on consumer side for beer would encompass your statement. Its harder for everyone not already in the beer game in Louisiana to get in the beer game.

And thats the biggest issue with our laws, we need to adopt something like texas has to encourage, not discourage, brewery growth.
