So then this is where it stands:

Jameis Winston linked to rape allegation
Jameis' DNA is found in victim's underwear
Victim went to hospital immediately after for rape kit
Injuries confirmed

How does he not get arrested? Even with the witness testimony, EVERYTHING else is against him.

its not that the witness statements carry no weight. It's that we don't know what they're witnesses to. The affidavit may say "bitch set him up." Or it may just say "I didn't see him rape her." Without knowing the content of the affidavits, they don't mean anything.

True. Although his lawyer seems pretty confident in the witnesses statements..

Then again he may have had time to "coach them up"

Again...the police is at fault for this issue not being handled a long time ago.

Less than that

She stated the rape ended at 2a, and FSU cops arrived at her dorm at 3:22a.

Within 90 min, which included the time it took for her to drive from the incident to her dorm, and the time it took for cops to get to her dorm. So essentially, almost immediately

There are many possible scenarios in this story. One is that someone other than Winston put something in her drink and Winston later hooked up with her.

Another is she was inebriated enough to lose judgment but by the time she went to the cops and had the blood work done, she'd processed a significant amount of the alcohol thus putting her back below the level. One thing to remember is the BAC levels don't equal the same state of mind for each person. Some people can get inebriated off a couple of beers especially on an empty stomach.

All that said, he very well may have raped her, or could be being set up by someone outside of the two parties involved right now. We simply don't know and rushing to judgment on either end is useless at this moment.

Yes, and seeing as she went to the police at 4 AM and this allegation may have occurred around a couple of hours earlier, then she'd have easily been below the legal limit for being drunk.

Again, though, BAC is a pretty arbitrary number and is meant to serve as an average. Some people could be at 0.1 and be stable and nearly fully functioning mentally, while others could be trashed and not functional mentally at as low as 0.04 or 0.05 BAC levels.

In the end, the statement of her not being drunk at the time she reported the case doesn't really mean she wasn't inebriated at the time of the crime.

OK but if she was "impaired" enough to where she didnt know what she was doing, her BAC would still be higher than it was. Because they said she was not inebriated. Which leads me to believe she barely drank.

And while I do agree that everyones tolerance of alcohol is different, I dont think anybody with a BAC level of 0.04 or 0.05 would ever be impaired enough to not know whats going on and being raped. Especially considering legal limits for driving is 0.06 - 0.08, depending on what state you are in.

The allegation occurred at 2am according to what i have read. And she was with the police at 4am. So, her BAC would be a little higher than what it was. But it wouldnt of been a huge drastic change. Especially if she was "trashed". And Im sure the police knows all about this haha.

But there also is the rumor where she was given a drink by someone that drugged it. So who knows? All I know is that by reports and her BAC she was not intoxicated.

i'd imagine the hospital would have done a blood test if it was THAT recent

it's unlikely, b/c i don't know many "date rape" drugs that would allow her to function to GET to a hospital in 2 hours

Ya i know what your saying. But when I say drugged i wasnt saying it was a straight up traditional date rape drug. Could of been Xanax or anything like that.

And yea if she was drugged im sure it would be in the hospital report. Could be. Just might not of released it yet.

And im not saying she was indeed drugged. Just saying there was a rumor that she took a drink someone with something in it.

Again, everyone reacts to things differently, and I've seen many people with significantly impaired judgment off of BAC's as low as 0.05%. The legal limit for driving has little to do with evidence of some minimum threshold of sobriety. It is an average used as a general gauge of the population, which is often why it is questioned for its validity.

In the end, she may have been inebriated to a degree of losing her judgment during and prior to the incident. Also, the body processes alcohol at different rates meaning the 0.02 reference you used is also an average rate and will vary from person to person and based on different activities.

She may not have been drunk, and he may very well have raped her, but everyone is jumping to conclusions still. That is my point.

i've had that happen to me (xanex slipped in my drink). there is no way i could have made it to a hospital, and had i somehow made it, they would have blood tested the shite out of me. xanex is a "date rape drug"

and i know it was xanex b/c i drug tested myself (urine) the next day. it was almost out of my system, fwiw

I agree with all of that.

0.04 - 0.05 is about 2 beers. For anybody over the age of 13 and 80lbs, 2 beers is not enough to make them so impaired that they would have no idea what they were doing.

I know people react different to alcohol and all of that. But 2 beers wont impair someone to that extent.
