Cops Asking about a firearm in the vehicle

Does a cop have to do this?

I reached across my 9 Under the seat of the driver side with a cop standing behind me when I was getting my wallet out of the console.

I thought they were supposed to ask?

The law in many States is that you have to disclose it up front. Regardless, it's good to let him know what you have and where you have it; regardless of the law.

Answer his questions. . . that's all. Don't volunteer any information unless he asks or tells you he is searching your vehicle. If that's the case, you probably did something pretty bad.

I don't have a fl license or permit to carry. I was scared shitless if he asked me if I had any firearms in the vehicle

I would have said yes

If they don't ask, don't tell. Unless the piece happens to be where your info is. I went through a checkpoint once, didn't think twice about my gun being in my console. He saw it and flipped out. I understand that. But that doesn't give them an excuse to try to turn my van upside down in a search without a warrant which they tried to do.

In LA, your vehicle is an extension of your home. You have a right to carry a firearm concealed. Don't carry it in the open.

Your best bet is to keep you hands on the wheel, let the officer know that you will comply with whatever he asks and then inform him that you are "legally carrying." Do not say "I have a gun." Thats just asking for trouble. He has the right to take the piece, unload and field strip it for the duration of the stop and then return it to you.

Just as a side not, carrying a firearm is not enough cause for police officer to stop you. US. vs. DeBerry shows that carrying a firearm is not "resonable suspicion" and is not cause for detaining an individual.

I have a friend that is LSP. He told me the best way to handle a gun in your vehicle is to tell the officer up front that you have a gun in the vehicle and follow further instructions from him. Of course he is giving that opinion from a law officer point of view. If I was stopped, I would do like he said, I would not want any misunderstandings with an armed law officer.

I walked all the way from our spot on the beach to my vehicle where I had my wallet

He was behind me every step

I can't believe you got a citation for drinking a beer on the beach. Did they ticket anyone else for that that you may have observed?

And also if you have a CC permit, they will see this once they pull up your driver's license information. It's best to notify upfront. Most officers will appreciate the honesty and sometimes let you go. I've had 3 LE members let me go for disclosing the information. They knew I wasn't a threat and appreciated the courtesy.

In TX they already know you are a CC holder by your license plate. We are required to show DL and CCL on traffic stops.

I wouldn't lie about it, if you are legal.
