If it is about a TEAM then how is a girl wearing a PINK TEAM jersey sent home?

So......if on July 4th (or veterans day) they allow kids to where patriotic clothes in lieu of the uniform,,,,,,,,,,can some douche from France or Germany or Korea wear their Nation's colors?

Actually, this is wrong. I swear to God you people seem to be ignoring the most important point in this debate, which I have made three or four times now.

Let's take a different example.....flag burning.

A flag is a symbol, and thus burning the flag is symbolic. Therefore, you cannot pass a law preventing the burning of a flag because you would be censoring the specific symbolic CONTENT.

You could prevent this action in myriad other ways. For example, you could make a law that bans public fires. You could make a law that bans political protests without a permit. Etc.

In the case of the school, it seems to me that if they allowed one football jersey to be worn, they would have to allow all football jerseys to be worn. It is all or nothing. You cannot say that only one type of jersey can be worn. That is CONTENT BASED.

Now again...the rules with regards to public schools are blurry. In the Hazelwood case, the Supreme Court ruled that school newspapers have no right to free speech. It is unclear whether or not this means no student has free speech rights in public schools.

So its a gray area. BUT, once again, this type of rule goes directly against pretty much everything the First Amendment stands for.

The reason they relaxed the rules has ZERO to do with this case. Stop trying to deny the fact that the rule put in place was applied EQUALLY for all. They could wear black or white..

Had the kid wore a black and gold COLTS jersey and was sent home you have a case.. However EVERYONE not wearing the correct dress was sent home.

The rule said they could wear jerseys now and not just colors?? You have a link to the exact rule and how it was relaxed?

So you are also saying that the banning of any shirt that can disrupt discipline in a school is allowed any time a school has a jean day?

I'm gonna type this extremely slow so maybe you can follow... Go back about a page and read my post, I said I have no fricking issue with the enforcement of the rule but the actual rule itself.

"Black and Gold Day" was set to target a certain set of individuals, those that root for the Saints. How fricking difficult would it have been to have "Superbowl Day"???

I'm not. I think I've plainly stated that the rule was stupid, not that it was applied incorrectly. And since someone pointed out the rule was put in place by the school board and not the principal, then the blame shifts down the line to them. Sounds like the principal was just following his stupid orders, although at the very least I hope he called the school board and asked if they really wanted to deny a kid a day of education because of the stupid rule they made.

Once again, that means absolutely nothing.

I could pass a law preventing hate speech in public places, and enforce that law equally for everybody.

It would still be unconstitutional. Indeed, the USSC said as much in a Minnesota case.

Presumably, you could wear Saints colors any day of the week. This was about jerseys.

For example, I doubt the kid would have been sent home for simply wearing a blue and white shirt. I have lots of blue and white shirts. I could have worn a blue and white shirt because I simply forgot it was black and gold day. I could have worn it because I don't care about the Super Bowl and didn't want to participate.

The kid wore a jersey, and that is the point.

This is a LA public school though.. They should have uniforms otherwise.. IF you wore a blue and white shirt you would have to be intentionally breaking the rules.

Do we know that this one public school doesnt normally have a uniform?

Im guessing you are not taking into account that in LA almost all public schools have a uniform they wear every day.
