Attorneys for Rep. Eric Swalwell (D-California) demanded Monday in a letter to FBI Director Kash Patel that the bureau refrain from releasing decade-old investigative files involving the congressman’s purported ties to a suspected Chinese intelligence operative.

The congressman called for the FBI to agree within three days not to release the files, adding that any further action to release them could prompt him to take legal action. The cease-and-desist letter followed a report from The Washington Post over the weekend that Patel had dispatched agents to review and redact the files in a potential move to ready them for a public release.

The cease-and-desist letter also warned against running afoul of the longstanding Justice Department norm that that law enforcement agents should refrain from taking any public investigatory steps against a political candidate in the 60 days before an election, to prevent even the appearance of the department using its power to sway the vote.

“For these reasons, we demand that you cease and desist from all efforts to publicly disclose any investigative files concerning Congressman Swalwell, including any effort to dispatch agents to gather, redact, and prepare such files for release,” the letter said.

The matter is particularly delicate because of Swalwell’s role in the California governor’s race.

The top two vote-getters in California’s June 2 gubernatorial primary, regardless of party, will move on to the November general election. Two Republicans currently lead in recent polls, since the numerous Democratic candidates are splitting the vote in the liberal state.

Democratic leaders hope their voters eventually rally behind one or two candidates, and Swalwell is among the leading Democratic hopefuls.

This outcome would be hilarious if two Republicans make the runoff freezing out the Democrats in a Blue State like California.

As many times it could have happened in Louisiana, either the Republican got 50%+1 vote, or the Democrats centered on one candidate in the jungle primary ensuring enough votes to make the run off and cause problems with the infighting Republicans. That infighting would lead to the Democrats having a chance, see elections of JBE and Blanco.

Obama gonna sit out of this one, since the only reason he won his Senate seat was due to a judge unsealing his opponents divorce files weeks prior to the election.

Democrats move the goalposts and whine when the those rules are used against them. Classic.

Oh nooooo. We can't have transparency about a congressman that was on the permanent select committee on intelligence committee, even chairing it at one point, being in a relationship with a Chinese Spy. Ohhh. Nooooooooooo. It may hurt his chances to advance his political career. Oh goodness. Can't have that.


It's time for some "leaks" for which it is also just impossible to find the source of.

If not guilty then he should welcome the additional media attention, right libs? He’s had help in hiding his crimes and this fool in particular along with Schiff need gone from the landscape

I seriously don't understand how a member of Congress can bang a Chinese spy, likely passing along critical US intelligence, whether knowingly or not, and remain in Congress.

Blows my fricking mind.

If you boil all this down to the raw ingredients, we have a sitting Senator who was literally in bed with a Chinese spy.....and is still "serving"

How was he still allowed to be on an any committees in the house when this came out?

One of the crazy aspects of this story is that Fang Fang died in an airliner crash in the mountains of China. The security footage of this thing a 737 in complete vertical dive from thousands of feet.
