My friend called me this morning as soon as my eyes opened to debrief this but I actually hadn’t heard about it yet. Should make for a spirited legal analysis.

Mangione's lawyers argue that his statements aren't fair game for trial because officers asked questions before reading his rights. The defense says the contents of his backpack should be excluded because police didn't get a warrant before searching it.

No chance they're going to get this excluded. They don't need a warrant to inventory the items you're arrested with, and evidence found from such an inventory can be used in court.

Well yeah, you dont read someone their rights until theyre being arrested.

Being approached and questioned by police does not count

That was my first thought. Do police have to leave you alone if you tell them you don’t want to talk?

His miranda rights only need to be read once he is no longer allowed to leave. If he was free to leave and he continued to answer questions, that is on him.

Checking the bag for ongoing threats such as a bomb is not illegal search do rights would not be needed in that immediate circumstance

His defense has to put forth something. This might be the best they can do right now.
