Daughter not listen on policy, gets in a wreck.

How screwed am I? Wife handled our new auto insurance policy. Massive screwup on my end for not overlooking.

Daughter gets into an accident on 75 south the other night, side swiped a semi. Thank God not a scratch on her. Her car will be a total loss, and I wasn’t even going to file a claim on it. It’s an older car and has been paid off for years. Unclear how much damage will he to the truck.

Here’s the fun part, wife tells me she was not listed our policy. We got the policy when she hardly drove at all. She’s 19 and goes to work in that older car.

I’m sure insurance won’t even think about covering our damage, however I wonder if they will cover the damage to the truck.

If this belongs to the money board, my apologies. Just slightly worried here.

Just say she borrowed the car.

They will cover it.

if you’re the owner and she’s only an”occasional” driver, you should be okay

Damage to some sort of fuel tank cover and the skirt. No clue on what we are looking at in damages

If your daughter lives with you, you should be fine. Just say she is an occasional driver.

Cars are insured , drivers are not. If I borrowed your car and wrecked it, they would cover it.

Depends on the application and policy. Were you asked about regular operators and household members. There are likely applicable exclusions but also companies in certain states can rescind the entire policy for the material misrepresentation. You are expecting coverage while not paying premium for the risk.

This is because you are covered as a permissive operator by the policy language. If you are a regular operator or household member you are typically carved out.

Insurance laws vary significantly by state. If you have a Kentucky insurance policy you need Kentucky answers. Some states have permissive user and some states do not as an example.

Does she live with you? As a resident relative, she would not be covered. If she lives elsewhere, she is a permittee and covered.

Regardless, if she is over 18 you are no longer liable for her torts.

It’s going to be tough, because the policy likely requires you to list as a driver any person over the age of 18 that lives in your household, irrespective of whether they are a resident relative. She would otherwise probably have been covered, but because insurance didn’t rate your premiums on the risk of a young driver that they didn’t know was going to be driving the car, they will likely deny.
