I’ve owned this house here for 19 years. With all the recent insurance issues my current provider dropped me.

I’m struggling to find a new provider that will write me due to a very large live oak limb that goes over the home. It’s been there obviously for much longer than the house has.

Anyone here dealt with A similar issue and found a provider that would write this?

I hate to cut the limb because I had an arborist tell me once that if I cut the limb I’d have to cut the whole tree down. It’s a beautiful tree but if that’s what has to be done whatever. Just figured I’d ask here.

TIA

Most carriers won’t write you if there are large limbs over hanging the house. You would be better off cutting it unfortunately

Don’t fall in love with a tree. The pain and suffering they cause if limb breaks or tree gets uprooted onto your house.

Did you try State Farm? They are not as tight with these types of issues as others.

Interesting. There’s trees all over my neighborhood. Near power lines, too. Try Gulf State. They wrote my policy after my insurer of 20 years left the state prior to Ida. Stay away from Lloyd’s, London if you can. They picked me up and gave me such grief for 2 years and super expensive. Got on with GS and premium went down and better coverage and so far no issue. Haven’t heard a peep from them. LoL put me through the ringer.

Not true. My neighbor has 2 large trees hanging over my house. Has dropped limbs and made us make 2 insurance claims. We were told (by an arborist) it’s still a healthy tree and we can’t force them to take it down. We have never had issue getting insurance. We have been in our home almost 20 years and had multiple different insurance carriers.

I finally found a carrier that didn’t mind the tree. I thought it was odd I mean it’s not like I’m in a unique situation. There are trees everywhere lol.

You do know that limbs hanging over your property can be cut at the property line?

was about to post the same thing...

anything on your side the property line, is your responsibility, not the person where the trunk is.... you can cut that son of bitch right where it crosses into your property

Typically you can't do it if it would kill the tree..."replacing" a large tree would incur significant $$$ damages since it's not realistic to replant a 100 year old tree

yes it is...

Art. 688. Branches or roots of trees, bushes, or plants on neighboring property.

A landowner has the right to demand that the branches or roots of a neighbor's trees, bushes, or plants, that extend over or into his property be trimmed at the expense of the neighbor.

A landowner does not have this right if the roots or branches do not interfere with the enjoyment of his property.

Acts 1977, No. 514, §1.

perfectly in the free and clear if it interferes with the enjoyment of your property

has no bearing, whatsoever, in LA

now, you SHOULD do the neighborly thing and try to come to some sort of agreement about the removal of the offending limbs, but if it's over on your side, you ABSOLUTELY can cut ANY limbs that are on your property

You sure? Typically you can cut but if the neighbor's tree dies you're held liable for damages, which can become significant in the case of an aged tree

Cc 688 only gives you the right to demand a trim if it's considered "interference" to enjoyment of property

100%

Typically

you keep saying this word, but i'm telling you what the actual law is...

quote:

if it's considered "interference" to enjoyment of property

and that is very broad, and i don't know how it is where the frick you live, but if it infringes upon YOUR property, it 100% can and is considered interference of the enjoyment of YOUR property...

what you can NOT do is cut the tree on their side the property, nor can you go on their property to trim the tree... and if the tree is directly on the boundary, then you head into some gray area, but if the tree is established on the adjacent property, but the roots or limbs come onto/into your property, 1000000000% you can cut every single offending limb and/or root, even at the risk of the tree itself...
