What would you say about a sitting President legally declared mentally unfit to stand trial?

Speaker Johnson can give testimony that Biden had no idea about an E.O. he signed on LNG.

They used an autopen for Biden.

Unless I missed the invocation of the 25th Amendment, it is not.

Just like we have the impeachment-removal process for acts while President, we have the 25th Amendment for this issue. That's the legal solution.

I knew without clicking it was the blowhard AG from MO, too. He's going to keep breaking your hearts after giving you hope with these silly lawsuits that are nothing more than ploys for media/optics coverage and pushing echoes into the chamber.

You think this is some kind of trick question?

The answer is to apply the 25th Amendment, and have that president removed from office. That didn't happen. Maybe it should've.

Prosecutorial discretion carries no legal weight, you'd need a judge, congress or invocation of the 25th amendment before January 20th 2025. And in the case of the judge making that ruling against Biden look for that judges ruling to really be a backdoor ruling against Trump as it would open up all presidential administrations.

It is rather unprecedented that the ones that directly surrounded Biden were the ones (one) that was running things using the autopen. So the regular 25th amendment is out the door.

Why would they remove a puppet?

Also, Speaker Johnson never said if when he was alarmed at Biden having no knowledge of the LNG E.O. whether he went to the VP or felt responsible to report it.

The 25th is essentially the VP's call. What do you do when the VP is inept and derelict of her duties?

No. It's not.

The Amendment is written for those people to have the power to start the process, even.

I think he 100% was.

That's irrelevant to the legal discussion.

We have the 25h Amendment to deal with scenarios like Biden. Had he been removed via the 25A and continued to submit "executive orders", THEN those would be illegal.
