You can’t deduct those expenses. Has it been alleged that Trump deducted the NDA payment? And what jurisdiction does a Manhattan DA have over Trump’s tax returns?
Also, the payment happened in 2006. Why is it being brought now? Defending this clear political prosecution is pathetic.

It's the NY business records law and the company is incorporated in NY.

Thats a good point, I wonder what the statute of limitations is on something like this, we're closing in on 20 years later.
