The kids were antagonizing the old man, but he could’ve swam away and avoided the whole thing. As for 1st degree it doesn’t seem premeditated. He was on the ground getting whooped before he went for the knife. Bottom line is this is why Wisconsin can’t have nice things.

quote:Admittedly, I haven't been following this case but near as I can tell, the "approach" was him trying to find something a friend lost.
But that isn't illegal.
Maybe there's some other video I haven't seen but nothing I'm seeing shows him being aggressive. What evidence is being provided that he was aggressive to anyone prior to them ganging up on him and harassing him?

He “ran” up to their tubes and grabbed their tubes. He chose the physical route. All words until that moment.

I'm not even saying the dude didn't start it or that he isn't guilty of something. I haven’t looked at it enough to have a strong opinion about that.
I just don't like the idea of using "he could've walked away" as part of convicting him of anything.

Agreed. Then he threw the first blow at a woman. Then he got punched for that. Then he stabbed another woman.
All avoidable.
1st degree is too much. That’s overcharging.

this is proof that knife defense skills are bullshite. that old man stabbed multiple people and caused serious injuries in the blink of an eye.

quote:well everything but there's no video of him throwing a punch at a girl; just those thugs screaming 'get him he hit a girl!'
What part did I misrepresent specifically?
also same thugs: "he's a pedo"

He was using a snorkel looking for a dropped cell phone from his group. The drunk teenagers started yelling at him from across the river so he thought they were gesturing that they had found his phone.
As he approached the drunk teenagers they continued yelling and laughing. He accidentally dropped his snorkel and mask in the water. The drunk teenagers surrounded him, yelled at him, laughed, and pushed him down in the water several times.
A second group stopped and two women joined in with the taunting. The women actually put their hands on him and the man was panicked out of his mind with 13 crazy, drunk teenagers all around him. (English was his fifth language.) As you watch the video, notice that he keeps looking down at the water for his phone and snorkel. He finally stabbed the people who had touched him and he walked away,

Things not on video don’t happen.

You realize there’s video of him running in the water and reaching down and grabbing their tubes?

I'm not saying I agree with stabbing but they basically harassed the frick out of the guy. Then, he grabbed their tubes..........they ASSAULTED him. That's kinda different, don't you think?

For one, he never said anything, he ran over to the group of teens and grabbed one of the teenagers while that person was sitting in a tube. Then they all got up and started laughing and taunting him because they did not know what he was doing.
He punched one of the girls there which was why they pushed him down. Then he pulled a knife and sliced open the first guy's stomach when that guy tried to push him away. You could maybe argue self-defense there but though the guy pushed him, never actually hit him.
At this point, he was stabbing anybody around him. He stabbed a girl in the side. No self-defense there.
Another teen walks up to try and get everybody to calm down and separate. This teen was not aggressive or attacking in any way and he turns and starts stabbing that kid. No way you can argue self-defense there.
He walks away and the teen that was killed chases after him and he stabs that kid. Could argue self-defense there but not sure you could justify lethal force considering the kid was not armed.
How many people on here would stand around and do nothing if some random guy punched a girl you were friends with in the face? I am going to assume none. Is he justified in stabbing multiple people who defended a girl he attacked?

He just admitted on cross to running up to the boys.
Either way, when he separated from them after that he should have walked away.
Sad no matter what.

How many times could he have walked away of those 14 steps.

quote:He definitely could have walked away. And, because he didn't, he's probably gonna go to jail.
How many times could he have walked away of those 14 steps.
But it's just pure delusion to describe the situation as if he started it. Poor dude just wanted to look for a phone and a bunch of shite kids lost their ever loving minds.
As such, while he may go to jail, I won't cry a goddamned tear for any of those kids.

If you were looking for a phone would you have handled it the way he did?
