I've read the covenant and I don't need your opinion on the clause. The current owner is leasing rooms. We are a single family neighborhood. There are four unrelated adults in the house. Good talk. Also why are they leasing rooms in a quiet neighborhood when there are plenty of apartments and rental units around?

How do you know they're not related or associated with her in some way? You're big and bad but won't ask her what's going on, just living in speculation. And again, speculating they're illegal with absolutely no proof (that you want to share with us.)

So, either you have something and have legit legal recourse or you don't and you wanted to come here and vent. I don't think it's the first one because you're here....

I would mind my own business and fully expect eerybody else in the neighborhood to do the same. Nosy assed neighbors empower the power starved and ill conceived notion of a proxy unelected government agency dictating how property owners can use their property. HOAs are the stupidest idea conjured up in the mind of man since the pet rock...and as useful.

I would proceed with caution. Whats good for the goose and all that.

We had a similar situation. Older Indian couple, empty nesters, placed one of their rooms on Air BNB. May have had a guest a couple of nights a month. Folks threw a hissy fit. HOA does not allow short term rentals. HOA sent everyone a nasty letter threatening all manner of litigation. Neighborhood facebook group declared a victory. Had a HOA meeting about a month later...HOA board, still controlled by the developer, let everyone know in no uncertain terms that short term rentals would not be tolerated. You'd have thought they had won a military camapaign...then they started listing their homes for Masters week...an age old tradition in our neck of the woods...our homes will lease for $8-$10k a week during the Masters. HOA sent everyone listing their home for Masters another letter stating it was not allowed and would be enforced. Folks having a stroke. Had a neighborhood meeting...hired attorneys. Lost at every turn. Those stupid motherfrickers did not like idea of that couple renting a bedroom a couple of nights a month and making a couple of hundred bucks and cost themselves $8-$10K in the process. Out of the 50 or so homes in the neighborhood about half of them are rented every year for the Masters. Ignorant fricks.


Not only did they lose their Masters income they also fricked around and the HOA is now enforcing a 12 month lease on all rentals...in a military community where about 80% of the residents are active duty military members and move at the whim of the military. We have a couple of rental properties in the area and 6 months is the norm...you can't list your home with the base housing office if you have to a 12 month lease because the military will only pay a 6 month lease if they PCS your tenant. These are $3K and up a month rentals. Stupid motherfrickers got involved in other folks affairs and now that it has cost them you ought to hear 'em squalling....best be careful what you wish for, next thing you know you'll be getting a $500 fine because your garage door was open longer than your neighbor thought it should be....

It goes back a lot farther than that. The cause of your issue is the way White Christian males treated the naggers of their generations decades ago.. The issue wasn't started from apathy or acceptance of lawlessness it was proactive behavior even when there was no lawlessness. It doesn't make it right but the causal link is how our forbears with power treated groups they saw as less than. It is a shame that the people responsible never had to pay the costs.

Does she own the house across the street, live there, and rents out rooms? If so, that isn't subletting. Even if she rents out the house she owns, that isn't subletting.

Subletting is renting out part or all of a property you rent from someone else.

If you don't want rules for what you can do with your property outside of what is or isn't legal, that you shouldn't live in a neighborhood with an HOA.

You have to agree to abide by the HOA rules when you buy a property in a neighborhood with an HOA.

Otherwise, I'm with you. I also do not live in a place with an HOA.

That's fine but the HOA covenants aren't for each individual homeowner to enforce. I can't go up to my neighbor if he's doing something against the rules and make him remedy it. If there are rules, the rules will also include how they're enforced. If he has some sort of problem, he needs to take it up with the HOA. It sounds like he did and didn't like their answer so he's boudae'ing here.

What if she'd sold the house to a new couple? You wouldn't have any idea who they are, their phone numbers, etc, correct? So why is this different, because they look suspicious to you?

Dude, you’ve provided nothing in this thread that shows that anything below board is going on. Zero facts. You basically said some neighbors don’t like that some brown people are living with an old lady across the street from you. And you’re getting slaughtered here.
