Well, that sane woman is now incentivized to make her spouse so miserable and disgusted that he initiates. I think you can define ways to mitigate bad faith exceptions through. Certainly wouldn’t be more ridiculous than the current state. It’s something that should probably be explored further, but definitely not a one sentence fix. How do children impact any of this?

My modification would be you only leave with what you contributed during the marriage if it's a no-fault divorce. You contribute 20% then you only leave with 20%.

What would be considered “proof beyond a reasonable doubt” in a civil court? A conviction? DV cases can stretch for months, so she would have to stay and endure abuse until he’s convicted? DV also isn’t just physical beating. Money withholding is often an issue in legitimate DV cases as a way to keep the victim in the relationship. Often times an abuser will also leverage the safety of the children.

Infidelity is another issue. Are just texts enough? Do you have to have video? Pictures? Cheaters can be very good at hiding things.
