He doesn’t know what he’s arguing. He alleges fraud, then when he gets shown there is no fraud, he argues that fraud isn’t a necessary element of the statute, when he’s shown that fraud is a necessary element he tries to argue again that fraud occurred.

How do you commit fraud by taking a loan from a third party that verifies values of collateral assets internally and was paid back all principle and interest from the customer on time per the agreed upon loans contracts?
No one with a 20th of a brain can read that and believe fraud was committed. Typical Trump political witch hunt.

Who was or is the victim of fraud in this case? The bank testified they were not defrauded and had no damages from any dealings with the Defendant?
