If Abortion isn't murder then why do people get charged with murder/manslaughter when they

either cause the premeditated/intentional death of an unborn child (murder), or the accidental death of an unborn child(manslaughter).

By legal definition, abortion not only is murder, but first degree murder because it is premeditated.
So it's not a crime when mommy/doctor intentionally murder the baby, but it's a crime if someone else does ?

How does that make sense from a logical standpoint, even for Pro Choice people?

It does seem inconsistent for some states fetal homicide laws to be incommensurate with their abortion laws. If a state allows abortion up to 12 weeks, do you think that fetal homicide laws should not apply to first 12 weeks to remain consistent?

I agree with everything you said. But if someone is pregnant and has an abortion then that child was unwanted, however if a pregnant mother who intends to have that child is murdered then in their eyes that child was wanted thus it is murder and not an abortion. Wow I know but that's just the way they think.

What if the mother has an abortion scheduled for the next day, and a guy punches her in the stomach and kills the unborn baby?

Is it no longer murder because mommy had an appointment to murder the baby the next day ?

Actually, by legal definition, abortion is not murder.
If it was legally considered murder, women who have abortions would be charged
with murder. Instead, they are charged with having an abortion.
There is no anti-abortion law stating that abortion is murder.

What he's going to tell you is that it's the mother's rights that have been violated and the law is to seek justice for her, not the unborn human who was killed.

But that doesn't really work, does it? I can't think of a criminal charge filed on behalf of someone else. If Susan gets raped her husband (who was caused emotional harm) isn't the one that justice is being sought for.

Civil? Sure. The unborn is considered her property (like a slave from 1860) and someone kills it, she gets to file a civil case.

But not criminal.

why do girls/women who give birth and then immediately smother the baby get charged with a crime when if they had only 5 minutes earlier up to the moment of birth had allowed a doctor to stab the baby in the birth canal and kill it that would be legal?

Honestly, I'm not so sure any of you actually believe it's murder by any definition.
