Gov Abbott can call out the Guard to stop invasions on his own initiative per US Constitution and Tx constitution. Feds not required.

Legally, Gov Abbott can stop the invasion of Texas if he wanted. Note in the US constitution that states can also reach interstate agreements to repel invasions.

US constitution article 1 section 10 clause 3

quote:

No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.

Texas constitution article 4 executive department section 7

quote:

Sec. 7. GOVERNOR AS COMMANDER-IN-CHIEF OF MILITARY FORCES. He shall be Commander-in-Chief of the military forces of the State, except when they are called into actual service of the United States. He shall have power to call forth the militia to execute the laws of the State, to suppress insurrections, and to repel invasions.

Abbott is such a huge letdown. Typical useless and spineless GOP governor.

Fed Gov would immediately call Texas NG into service to counter any move Abbott tried to make with them. That's the great equalizer.

"Oh, you want to put your NG on the border, huh? Well we need them to help the recent influx of illegal immigrants that have made their way to the northeast recently."

The problem is the state of TX does not control the points of entry. FEDGOV does. Abbott isn't going to send the Texas Rangers to the border to arrest the border patrol and INS agents to get them out of the way.

I'd like to see them use deadly force until nobody is crossing anymore.

It's ridiculous that we have been allowing this to happen for 30+ years.

Not according to this (from when Trump was in office):
https://www.desertsun.com/story/news/nation/california/2018/04/08/heres-what-could-happen-if-jerry-brown-refuses-send-ca-national-guard-border/497747002/

quote:

Stirling said governors are the “commanders in chief” of the state national guard and the guard is under their sole control. The president does have the power to federalize any state national guard, but then the guard would be subject to federal laws which prohibit the military from enforcing domestic law.

There are multiple ways the current situation could play out, he said. Brown could refuse to deploy the guard, and a standstill could ensue. Trump could federalize the California National Guard, but then could not use them to enforce immigration law. The president could also direct the Department of Defense to strip away federal authority from the guard, known as decertifying, and slash their funding.

“He could direct the Pentagon to decertify the California National Guard,” Stirling said. “If he does that, of course, he would be cutting off his nose to spite his face, because then he wouldn’t have access to the California National Guard.”

He also has the Texas State Guard (Not National Guard) at his disposal.

it would be interesting to see how many of those NG troops failed to show up and for those who did how many fail to fire on fellow Texans at the order of Biden and Miley

States can declare martial law. Use the invasion for cause. Suspension of ordinary law and end the invasion.

The Texas National Guard is 19,000 troops. Get other red states to agree to send troops as well. End the invasion.

This is an invasion and the security of the country is at risk. Unfortunately, our ruling class including the GOP appears to have no problems with this invasion. Gov Abbott seems to like public gestures but real action, no.
What is wrong with him and the republican party???? If we value our society and security, this invasion must be taken seriously and ended.

Who gives a flying frick? They've already made us a victim. They just had some Mexican gangster kill a bunch of white people at a mall and they are blaming it on white supremacy. It's long past time to care what people say and start doing what is right for the sake of it being the right thing to do. FFS, we have got to quit giving all of the power to the idiots on the left!

Biden and Milley cannot use the National Guard to police domestic issues. That is at the sole discretion of the governor.

I don't think they can be federalized if they are already deployed in a domestic local emergency.

I hope Texas takes matters into its own hands. Tells the feds to back off and seals the boarder. Then is supported by other boarder states. There are specific laws regarding invasions that authorize this.

Not if they are already deployed. It's not as cut and dry as you think and there is also precedent in what I am saying.

Plus, it has to be a time of war for them to be federalized. Are they going to declare war somewhere just to pull the Texas NG?

Wisconsin Rep. Tom Tiffany reveals that "As many as 700,000 illegal immigrants are EXPECTED TO CROSS THE SOUTHERN BORDER ILLEGALLY in the next few days."

I THINK the problem, someone correct me if I'm wrong, is he may not be able to stop it on the actual border line, so puts the illegals on American soil before TX can do anything.

IE...they can cross the goal line and TX is having to count 10 Mississippi's before they can make a move.

So why they can try to make it illegal to be illegal in TX, I know freaking ridiculous sounding. I'm thinking that every illegal they encounter on the streets of ELP, etc they arrest and they tell them the have 3 options...1) go to jail for being illegal 2 ) return to their home country 3) heres a list of sanctuary cities you will be bused too and you can't return or be arrested and sent back. Obviously take pictures, fingerprints, DNA for all I care, etc.
