Found the following in the New York Post

Sounds as if they were not charged at the scene because they were juveniles. Klotz can still have them charged in the juvenile system, if he files a formal complaint. Sounds like he is not going to exercise that option.

Basically, he is complaining that "someone should do something," while declining to do his part to get the ball rolling in the system.

Additionally, New York law allows the 17-year-old to be charged as an adult.

Nothing inconsistent.

He said he asked the cops what would happen.

Then on the show this morning he said he didn’t want to ruin their lives but also said he wanted people held accountable, implying the mayor, parents, etc
