Race hustlers may be evil but they are not stupid.
The media and political zeitgeist gives them all the power and they are taking advantage of it.
This guy won't "win" the lawsuit but he will get his ultimate goal. McDonalad's is going to start spending more on advertising on his networks just to shut him up.
