Property damages and how to proceed

We recently paid for a house pad and road on our property. Before the rain, a lumber company in the area dropped off form boards and rebar in our yard mistakenly as there is also someone building right next to us.

It’s been raining pretty heavily in my area so I blocked off my drive way and put a no trespassing sign so that no one rutted up my road while it was wet.

Fast forward to today and I go check on the property and by blockade has been moved and the form boards have been taken from the property but the rebar and wire matted remain. There are ruts in my road from where the company came to pick the material up and move it to the other yard.

I call them and they say they will pay for a portion of the damages but want to see how bad it is when it dries up. Told them I planned to get an estimate from my guy and that would be the price they pay.

Do I need to lawyer up on this now? Thought about going ahead and filing trespassing charges but I’m not trying to be an a-hole. I just want my stuff fixed like it was. Any advice on this one or similar stories of property damages?

No. Be amicable right now. Let them come look. Present your estimate and see their response prior to you spending money on an attorney

Anytime anybody threatens with “their attorney” from the start, I laugh and call their bluff.

You can go to the sheriffs station and file the paperwork with pictures to get it documented. Will be your time and they won’t pursue it unless you push it. It does however get the damages done on official record

Your contractors and material delivery guys will appreciate your efforts to provide a smooth road to rut up the next time it rains

Seriously your yard and road will look like a battalion of WW2 tanks have been in and out of there by the time the build is complete. You're fighting a losing battle if you think otherwise. Fix it once when the build is over.

As a licensed attorney, I love doing business with your types.

The phone call after a petition is served is usually pretty fun.

Got a report documented and will wait for it to dry to assess the damage. Called my dirt guy and told him to give me an estimate so that I could get to the company.

Sorry if that’s confusing pal, the gentleman that I hired to bring dirt and work it on my property.

i know I will probably be in the minority, but i just can't get myself worked up over ruts in my yard. I just have too many important things to worry about. Rut my yard up all you want.
