Can Desantis suspend Warren BEFORE he has actually refused to prosecute an actual case, solely on the basis that Warren stated an intent not to do so if such a case arises? I don't see anything saying that an elected official may be suspended IN ANTICIPATION that he MAY engage in (e.g.) neglect of his duties.
You raise a good point.
Perhaps one could argue the mere stated intent to not follow law undermines determination to investigate? But that is far less solid than if non-prosecution or case scuttling had already occurred.

DeSantis Didn't Just Suspend Soros-Funded Prosecutor, He Sent the Police to Evict Him from Office

I’ll ask again, for the 6th time, people here say you are not a lawyer? Is that true? You keep acting like one but your ignorance of Florida law is astounding. Perhaps look up the prior suspension for similar conduct.
As a lawyer you would know that. I guess it is all a charade with you. However, any lawyer in active practice would not have the time to post in here all day like you do.

quote:You are a strange little person. I do not live in Florida. I acknowledged in my first post that this action was probably legal under Florida law. Desantis is too smart to do something like this without at least a goid faith legal argument. I still find it odd that one elected official can usurp thexwill of the local voters and unilaterally remove a local elected official. It seems to me that (if his constituents do not like his performance) the remedy should be at the ballot box.quote:your ignorance of Florida law is astounding.
I find it odd that a governor has the unilateral authority to remove another ELECTED official.
The adults have looked at the statute in this thread, and I am not alone in questioning whether the preemptive nature of this action would survive judicial scrutiny.

Why does Warren think he should be able to keep this woman from doing her job? Not a good look for a progressive.

I suppose it is a reasonable question to ask.

I favor the Florida Constitution and the Governor, elected by the people, doing his job to ensure the people are being served appropriately.

The question may be answered by a Florida court or by the Florida Senate. It will be interesting to watch.

The Governor of NY can do it also, do you have a problem with that?
