No. To be covered by HIPAA, you must be a health care provider, a health plan, or a health care clearinghouse. There is nothing to suggest that one of these "persons" disclosed the information.

sort of true. anyone with reasonable access to the data can be held accountable. source: I am a data protection specialist, and I regularly undergo HIPAA reviews because I manage the backup and recovery of data that may be in-scope.
