California Assault Weapons Ban coming back to chopping block.

The 9th Circuit, which had issued a stay when a district court had ruled the 1989 CA AWB unconstitutional (Miller v. Bonta), has vacated that stay and remanded the case back to the district court for a ruling consistent with NYSRPA v. Bruen. Saint Benitez struck down the law under Heller, so this is pretty much just procedural. That AWB is going down and this time the 9th Circuit won't be able to bail CA out.

On a side note, I have the utmost respect for the legal professionals and their less then credited mastery of the English language. I can barely get through a single sentence in a judgement without going back to the beginning and starting over.

Basically the CA AWB was struck down, CA appealed to 9th Circuit asking for a stay on that ruling so that the law could still be enforced while under appeal. The stay was granted pending the result of an appeal. Now that stay has been recinded and I believe they vacated the original ruling, now the case is back with the lower court for a decision based on the recent SCOTUS opinion.
Also, Duncan v. Bonta (CA firearms purchasing age case) will be impacted soon as was the case for high capacity magazines.

It also might be all moot too. The SCOTUS has distributed four cases for conference it had on hold pending v. Bruen today, one of these is Maryland's AWB. I don't know if they will grant review for certain, they might want to vacate the lower court decisions and remand them.

NYSRPA v. Bruen could realistically impact the NFA. Any reason you're such a fan of the NFA?

The Hearing Protection Act that would have treated suppressors the same as firearms (just a standard 4473 background check; no NFA $200 tax stamp and 6-12+ month wait) was poised to be approved and had already cleared the committee. . Then the Las Vegas shooting happened. And that bill died that night. Strange thing that Las Vegas shooting.
So to answer your question, probably never unless you want to go the tax stamp route.

I wonder if SCOTUS' decision from last week can be used to fight the attack on ammo. Or maybe the EPA one of it goes for the good guys?
