If Watson is found guilty, draft picks and money question

Clearly the draft picks are gone, but how does the guaranteed money work? Is it actually guaranteed no matter what or are there clauses that he has to play or be on the roster etc?
Would this affect the browns cap hit?

There’s no way there isn’t something in the contract to get them off the hook for the money if something like this were to happen. I’m not sure how the browns would play it out if found guilty on the civil side though

This was a dumb arse deal by the Browns.
They are really taking the mantra "there's no such thing as bad press" to heart. Never should have anchored themselves to this guy.

Him being found guilty of anything criminal at this point is extremely low. Grand jury already passed on most if not all these cases
Browns have some level of protection in case this goes haywire supposedly, but they would have a long fight on their hands trying to get that money back by claiming the new allegations materially effected the deal signed when he already had like 23 of em when they made the trade and contract

Not sure he’ll be found guilty of anything at this point. I do think he will be hammered by the civil suits. What a nightmare for the Browns. This is not going away for them, and it’s crazy that they showed this level of commitment with that contract.

I don’t think the criminal element is going to bite them, I think it’s the impending suspension. Goodell can’t go light on him in this climate, and more keeps coming out making it worse.

First the Browns minimized the damage a suspension can do to his pocketbook, his salary for 2022 is only $1 million. An eight game suspension would cost him less than $500K.
His contract is fully guaranteed, including the allegations that were leveled against him. He provided all information to the Browns about what happened, the Browns were satisfied.
However the 24th and many of the subsequent women identified by the New York Times were not in their discussions. The Browns can void the contract and claw back the signing bonus, if he faces any discipline regarding any woman not previously disclosed to the Browns.
I'll try and find the article I read on Sunday about this situation.

Browns would get cap relief for any games he's suspended or if his contract is voided.

They would only get relief on his base salary for a suspension, which they lowered to 1.35 mil this season
And it would take a lot of unlikely things to happen to get the contract “voided”. Good luck fighting that in court.

Its all in his contract- he disclosed his actions with 22 women, the stuff the 24th woman stated was not disclosed to the Browns (based on what his lawyer said he didn't know either), nor did he disclose what the New York Times is reporting.
24th accuser allows Brown to void deal
quote:
full copy of Watson’s contract, the contract exempts from the standard default/guarantee void language a suspension imposed by the league “solely in connection with matters disclosed to Club in writing pursuant to paragraph 42 and such suspension results in Player’s unavailability to Club solely for games during the 2022 or 2023 NFL League Years.”
In paragraph 42 of the contract, Watson “represents and warrants (except as disclosed to club in writing), as of the date hereof, that (i) Player has not been charged with, indicted for, convicted of or pled nolo contende to any felony and/or misdemeanor involving fraud or moral turpitude, (ii) Player has not engaged in conduct which would subject him to a charge, indictment or conviction of any such offense, and (iii) no circumstances exist that would prevent Player’s continuing availability to the Club for the duration of this Contract.”
The written disclosure was not attached to the contract. A source with knowledge of the document told us in April that it’s a “fair assumption” that it refers to the 22 pending civil lawsuits.

Watson is guaranteed $180 no matter what

I’m not disagreeing they could potentially void it, but we are a long way from that being the case and even if they go that route it’s going to take a long legal battle to get that voided fully. As I mentioned earlier it would take this 24th allegation going all the way to an indictment or conviction- which seems unlikely.
Those void clauses are always fought in court for years after the initial dispute. I think Fournette is still doing one to reclaim guarantees voided from the Jags on his rookie deal.

Nice article. Thanks for sharing.
Didn't know about that part. What's the backstory on that?

So theoretically the Browns can argue fraud in what he disclosed if they want out of the contract?

Also not mentioned is depending on how the verbiage in the contract is set-up; there is a possibility that if he's suspended a full year, or finds his way on the Commissioner's exemption list, that the year won't count and the contract could essentially shift a year. Not sure how that affects signing bonus money as that would have already been paid

He would get his fully salary on the exempt list and his contract would toll towards the next season.
If he got suspended his contract would toll and he would lose out on the base salary for each game he was suspended for. Browns, in order to save space and to entice Watson to choose them, decided to lower his base salary to less than 2 mil this season, that way if he is suspended he doesn’t lose that much money and they have some leverage of financial freedom to make the numbers work to add on his deal.

So glad that the Texans are on the winning side of a trade

I wouldn’t call them clean winners just yet they could face some severe punishment if there’s more legs to their role in the entire situation between Watson and these massage parlors. Definitely not below the league to pursue a punitive result on the Texans if this blows up completely (again unlikely)

My prediction is that Goodell gives him the first two year suspension in history and the Browns try to void the deal due to the other events he didn't tell them about
