Section 30-2-5.A - Excusable homicide.
quote:

Homicide is excusable … when committed by accident or misfortune in doing any lawful act, by lawful means, with usual and ordinary caution and without any unlawful intent

It's not excusable to intentionally point a loaded gun at someone and then pull the trigger on purpose. When is that ever a lawful act?

But Baldwin is a Prog,, so he is GUILTY, reeeeeeee

This sort of comment doesn't have anything to do with me, so stfu.

Why is Alec Baldwin responsible for murder?

I think most reasonable folks would say it’s manslaughter or negligent homicide.

Involuntary Manslaughter under 30-2-3.B is definitely the correct charge … if charges are brought.

But no charges will be brought.

Not because of some political nonsense. Because the State cannot possibly meet its burden of proving (beyond a reasonable doubt) the assertion that Baldwin did not exercise due care.

“More likely than not?”. Sure, they might be able to meet that (inapplicable) burden. But “beyond a reasonable doubt? No way a prosecutor wastes resources on a loser of a case like this.

From what I’ve read there’s no way that could describe that set and their treatment of firearms.
