Because even though he can, he won't until the Governor basically gives up and says he can't handle it. Which is what I thought happened late last night, but I guess not.

Send in Active Duty so they can finally do something otherthan do PT everymorning and sweep the motor pool.

Actually it is, those Governors just have to request it.


Sending in a be feds without permission and with permission are two different things. The latter is how the republic works. Not the former as suggested by the OP.

It isn't without precedent to send in active duty troops in situations like this, Posse Comitatus or not.

But this is actually, imo, the least likely scenario. I think what will happen is that he will federalize the national guard to handle it. The military has a plan for this (can't remember the name at the moment). The President can direct the national guard without consent of the governors but he won't do so until the Governor has basically thrown his hands in the air and said he cannot handle it.

And again, the Governor did this last night on national television when he announced they had lost control of Minneapolis. IMO Trump could move the national guard in right now if he so chose to do so and I can't understand why it hasn't happened already.

The president can send the regular army under the insurrection act. But its like the other posters said. This is if the state is overwhelmed. Thats how a republic works. Clinton did it during rodney king riots.
