Yep, President has Constitutional obligation to nominate/appoint, Senate has Constitutional obligation of advice and consent.

Nominated by the Executive and the Senate advises and consents.

That is all.

All the screaming and the gnashing of teeth that is soon to follow means nothing. The Constitution is the precedent.

You could have a lame-duck President nominating a justice approved by a lame-duck senate. It just has to happen before Jan. 1 when new senate takes over.
