Murrill needs to mention in this answer that vaccination will not prevent healthcare workers from transmitting Covid to vulnerable patients but it doesn't sound like she's going to.

Because, just like the OSHA case, it has no bearing on the actual issue before the court.

Because him actually needing an explanation of such a basic concept would imply that he is an idiot.

He wants it on the record so that it can be referenced in the future and be cited in opinions. Setting up the basis for their eventual written opinion and making sure those things are on the record (if not in the briefing) is half of the reason they ask questions to begin with.

Multiple justices have referenced parens patriae today, the doctrine that grants the inherent power and authority of the state to protect persons who are legally unable to act on their own behalf. So I would argue that a vaccine mandate doesn't protect those vulnerable patients as claimed, since vaccinated healthcare workers can still transmit the virus to them.

Policy determination. Both of these cases are about authority.

Agreed and parens patriae is by definition a doctrine about authority.

The justices brought it up so it can be rebutted that parens patriae is not applicable regarding this case since vax status doesn't protect others.
