In La. back in 2003 which ever parent was calculated to be responsible for 70% or greater of the child support was automatically given the child tax deduction.
It was later amended to include "the courts discretion".
And yes, I was audited and had to prove to the IRS that the courts awarded me the child tax deduction.

The judge dictated the mother claims the child and also doesn’t have to claim child support as income. I can’t claim child support as an expense so, the mother doesn’t pay tax on the income and can claim the tax credit. Should be every other year.
