That's what (I hope) is next to happen...CNN is already threatening...reinstating the Smith-Mundt act might shut them up permanently.

Fake news is legal because of the first amendment.
A Broadcaster/Cable Company/Newspaper/Radio Station can transmit whatever they want. About the only limit is that they cannot say things about a private figure they know are not true, or say things about a public figure they know are not true with malice. Given that anyone who is 'newsworthy' becomes a public figure, and that it is virtually impossible to prove malice, they can pretty much say whatever they want.
What Smith Mundt did was authorize the State Department and the Broadcasting Board of Governors to carry out propaganda activities, while preventing those activities within the US. What the "modernization act" of 2012 did was to allow those materials to be distributed within the US.

Regardless of your politics, it would be nice if we had a network that reported without bias. Report on facts, what was said without interpretation. Hate hearing from “analysts” that are presented as journalists. Tired of researching every single issue.
