I've never met an educated person that wasn't a supporter of the 1st Amendment. Most near absolutists. Am I reading your comment correctly, you're good with government controlling speech beyond "not yelling fire in a crowded theater" sort of thing?

Do you support a near absolute right to speech? Again, pretty much everything goes with the exception of speech that results in immediate and substantial risk - like screaming "fire" in a crowded theater.

In terms of criminal, damn near. The nucleus of operative facts for a "fire in a theatre" scenario to become criminal to me is extremely rare. Now where we get into issues will be fraud, but fraud-based crimes must include other variables, too.
