This makes no sense.

It was constitutional for one President to establish DACA, but it's unconstitutional for a different President to get rid of it?

SCOTUS will just have to spank some more judges. If there were any real justice these people would all be removed, because the rule of law has nothing to do with how they rule.

This is so weird,

Judges supporting unconstitutional acts.

They really are dictators in black robes with no respect for the rule of law.

No it was unconstitutional for Obama to do it. Only Congress can establish law, Obama admitted as much prior to his EO.

To be fair, injunctions are often granted if the outcome is not easily “fixed”.

So, I can see why not allowing a deportation while that issue is before the Supreme Court is defensible.

You can’t easily undo the deed in the event that the decision goes the other way.

I don’t LIKE it. I do understand why it might happen. Just trying to be reasonable with the understanding.

I have no idea. This one did not.

This judge only said Sessions erred when he said DACA was unconstitutional.

Sorry, I’m lazy. It’s more for the group (I’m looking at you OP) than you directly.

Exactly!

However, the Dums claim that DACA is a policy not a law and it is true that no court has actually ruled it unconstitutional.

Neither judge has said that.

First judge: DACA has to stay in place while litigation is ongoing. See my first post. This injunction is very common.

Second judge: Sessions is incorrect when he said DACA is unconstitutional

That is ALL that has happened. Really not an affront to American justice or Constitution.

ETA: I expect Trump to prevail in court and I think that is the right decision. But, I am not upset at the process.

You are correct and I've edited my post to reflect that fact.

I am. What one EO can create, another EO should be able to undo without having to tapdance through the judicial system. That any judge put a hold on moving forward to undo this, to me, is overstepping their authority.

Who give a shite if it is or it isn't?

It's a fricking Executive Order that can be reversed with the stroke of a fricking pen.

I'm interested how you know this. Not saying you're wrong, just curious. They teach law in helicopter school?

More federal judges need to be impeached, this judicial activism and, in some cases, open defiance of SCOTUS precedent is simply ridiculous. Pragmatism and common sense should always prevail idc who TF you are.
