He's not talking about whether or not the decisions were Constitutional but whether or not the outcome was beneficial to Republicans.
Considering that leftists don't care about the Constitution and actually act against it, it makes sense that the leftists on the court wouldn't vote along side the more Conservative justices.

He's also painting a picture of a "pattern" with all these 5-4 decisions, A) hoping nobody considers whether they were the right decision, and B) hoping we ignore the 4 on the other side and their just as apparent "pattern."
