You really can't tell from the photo, and I know you can't be naive enough to believe something because you read it on the internet especially when it's political with 1 side against another.

Well, I don't see a rifle in that. I see a a very fuzzy, compressed extremely LOW-QUALITY image and if I were a conspiracy wacko, I might immediately be susceptible to the suggestion that it is a gun, but since I'm a rational person and using my vast knowledge of surveillance and reconnaissance systems for the U.S. military, intelligence agencies and state department, my educated guess is that person is using a video camera (which in many cases are also black) and have optics about the same size as a reticle scope.He doesn't appear to be holding it in the usual manner of a DSLR Camera, but for a person using a video camera, that fits the profile.

I agree that I can't tell, if it is a camera or a rifle, because the lens of the camera/phone that took the photo, is pointed directly at the lens of whatever the guy on the roof has, so the image is 2 dimensional.
The guy on the roof does appear to be in a prone unsupported shooting position though, at the edge of a flat roof. Would he need to be in that position if he just had a camera or spotting scope?
Then again if he was going to be set up just in case he needed to do some shooting, why didn't he bring a bipod or at least some sandbags?
