You're mis-stating the argument
The argument is "lawfare" is another malleable term that shifts as is necessary for a particular point/argument. Like "globalism", "Deep State", etc.
I'll give an example. Alabama just passed a patently illegal law (death penalty for sex offenders). Was that law fare? Will it become law fare if they ever try to enforce it? Will appealing a ruling be law fare? Can its law fare status be cleansed with a wholesale change in the law by the USSC? What are the rules/definitions?

Your example is meaningless because there is no political component or weaponization of a political figure.

Lawfare is the selective enforcement dependent on a set of variables such as political affiliation.
Did NY selectively go after Trump for over valuating property to get more favorable loan terms or did they go after everyone they suspected of doing this?
Did NY change their statute of limitations to speficslly go after Trump or did they go after everyone that would have been subject to the statute after changing it?

Did the candidate for NY AG specifically run on "getting Trump"?
There's a reason the VAST majority of TROs/injunctions/stays that have been routinely reversed/lifted by higher courts are coming from O'Biden judges.
