Then get the statutes changed.
They don't need to be rewritten, simply reinterpreted. You should understand that. That is what you base your reasoning on.

Little known fact, in the 1990’s they were utilizing USMC and Army units for patrol the border under the guise of “training activities.” They were armed and the ROE was only to fire it fired upon. A USMC platoon shot and killed a teenage rancher who was shooting a .22 at rabbits. That ended the practice of using the military on the border in short order.
THANK YOU for reminding us of this fact. I clearly recall it now with your assistance.
I know that we have active duty at the border pulling security duty. That is a fact. It's also a fact that the USMC did this in the past. It's a fact that they were armed with their personal weapons. We know for certain this is so because a foreign national was actually shot by a Marine.
Thank you.
ALL of the convo about the application of the PCA is academic because it does not prevent the US military from pulling armed guard duty on the border. Period.

The kid was an American citizen. He was not hunting rabbits. He was herding his goats. He had a small-caliber rifle with him, but he did not fire it at the Marines.

the marines had followed the youth for about 20 minutes through the hills, and his fatal bullet wound indicates that he was not aiming at the marines when he was shot by Cpl. Clemente Banuelos, 22, from a distance of about 230 yards, said James Jepson, the prosecutor in charge of the case. '
'The problem is, the evidence at the scene and the evidence from the autopsy are not consistent with the marines' statements,'' Mr. Jepson said in an interview
the marines ... waited 22 minutes to radio for medical aid for the young man, had rendered no first aid other than to check his pulse as he lay dying and had initially told a deputy sheriff arriving at the scene that the youth had hurt himself by falling into a well.
In 1998, the U.S. government paid the Hernández family $1.9 million to settle a wrongful death claim.

You people!
Dale51 has some of the weakest, shite takes of anyone on this board. I’ve yet to see a topic on which he’s capable of providing worthwhile insights.

Trump has totally punted on the border. He literally handed over everything re: immigration to Jared Kushner (OY VEY!).
The fact that he wasn't removed from office shouldn't be viewed as a victory, but as a sign of his total surrender to establishment forces.

I didn’t say he was hunting rabbits, I said he shot at some rabbits. He was herding goats but fired in the direction of the Marines at one point. He didn’t even know they were there. The prevailing theory was that he shot at a rabbit as he would often bring them back to cook. They cited the shots as part of their justification as to why they fired back. That is based off the statements of the marines. The kid obviously didn’t get to tell his side. I remember all this because I lived and worked on the border back then.

This particular input of yours is completely irrelevant to the conversation on the topic at hand. It adds absolutely nothing to either support or refute my analysis and conclusions.
I'm still waiting for Centinel to explain why he thinks that the active duty forces currently patrolling our southern border are unarmed.
